Language versions of the GTC

These General Terms and Conditions are made available in several languages. In the event of contradictions, questions of interpretation or ambiguities between the different language versions, only the German version shall prevail.

The foreign-language versions are provided solely for ease of understanding and have no independent legal effect.

Scope of application

  1. These General Terms and Conditions (hereinafter referred to as GTC) apply to purchase contracts concluded by private and / or legal persons via the Tradingzone AG online store.
  2. These GTC also apply to purchase contracts that are concluded in a manner other than that specified under  1. 1 (e.g. in person, by telephone, letter, fax or e-mail, etc.).

Prices

  1. Unless expressly stated otherwise, all prices are quoted in Swiss francs (CHF).
  2. All prices are calculated  including VAT and processing fee. Customers with a B2B login can display prices excluding VAT. This will be activated by Tradingzone customer service on request.
  3. The  shipping costs will be charged additionally to the buyer s account.
  4. Tradingzone AG reserves the right to change the published prices at any time.
  5. In the event of discrepancies, the prices and conditions stated in the online store at the time of the order shall apply.

Payment

  1. Payment on collection on site in cash (CHF), by credit card (Visa or Mastercard), EC card, PostFinance Card or TWINT ;
  2. Prepayment: 
     In the case of prepayment, the delivery will be released for dispatch after receipt of payment;
  3. Payment on invoice:  When paying by invoice, the invoice must be paid within 30 days of receipt of the invoice, unless a different payment term is expressly specified. The buyer can find the relevant payment term on the invoice, which is provided exclusively in digital form (by e-mail and as a download in the customer portal). The invoice will always be sent to the e-mail address provided by the customer immediately after the order has been transmitted. 
    Tradingzone AG reserves the right to obtain credit checks on the customer and is entitled to pass on customer data to third parties in this regard. 
    Information on payment processing can be forwarded to the Swiss Creditreform Association. Verband Creditreform. 
    In the event of late payment: The invoice amount is due for payment at the latest on the calendar day specified in the invoice. The default interest rate is 9%. The contractor reserves the right to refuse an order until the entire outstanding amount has been paid. CHF 15.00 will be charged for the first reminder and CHF 20.00 for each subsequent reminder. The collection is carried out by Creditreform Egeli St.Gallen AG. 
    The expenses incurred for this are subject to reimbursement and depend on the amount of the claim. The fees after an unsuccessful second reminder amount to CHF 60.00 up to a claim amount (FH) of 50, 100.00 to FH 150, 125.00 to FH 300; 190.00 to FH 500, 260.00 to FH 1 000, 350.00 to FH 2 000, 530.00 to FH 4 000, 900.00 to FH 8 000, 1 330.00 to FH 16 000, 2 000.00 to FH 32 000, 2 600 to FH 50 000, from FH 50 000 they amount to 5.5% of the claim.
  4. Retention of title: The goods remain the property of Tradingzone AG until full payment has been made

Terms of delivery

  1. General information

    1. Unless otherwise agreed, purchased goods can be taken away directly on site.
    2. Delivery takes place within the  Switzerland  and the  Principality of Liechtenstein.
    3. The benefit and risk of the delivery shall pass to the buyer or the commissioned forwarding agent when the goods leave the warehouse.
    4. For  special deliveries  (e.g. items with unusual dimensions, extreme weight, etc.) the delivery costs  will be calculated on request.
    5. The delivery costs will be charged in addition to the sales price  at the expense of the buyer  .
    6. For deliveries for which the delivery or collection date is more than one month in the future, Tradingzone AG reserves the right to charge the storage costs incurred for interim storage until the effective delivery date (CHF 5 per pallet / week).

    Cost of delivery on site to kerbside

    1. From an order value of CHF 6,000.00  the shipping costs for delivery to the kerbside shall be borne by Tradingzone AG.

    Costs of delivery on site with installation and assembly

    1. On-site delivery with installation and assembly is charged additionally and (if not automatically shown by the store) on request. As these deliveries require additional logistical effort, delivery is possible within 1-2 weeks. We always offer you the earliest possible delivery date. A requested delivery date specified by you will be met if possible. We will inform you of the definitive delivery date in writing by e-mail;

    Cost of collection on site (Tradingzone AG in Regensdorf)

    1. On-site collection means that the goods are collected in Regensdorf.
    2. There are no additional costs for the buyer for collection on site.

Warranty conditions

  1. Unless expressly agreed otherwise, the following applies to all second-hand products  "without guarantee" Any guarantee claims for these products are expressly excluded by Tradingzone AG .
  2. Tradingzone AG guarantees that the goods have the warranted characteristics, have no defects that impair their value or suitability for the intended use, and comply with the prescribed services and specifications for the period specified at the time of purchase.
  3. It is generally not possible to return furniture to Tradingzone AG.

Notice of defects (Art, 197ff OR)

  1. You can notify Tradingzone AG of any defects (lack of warranted characteristics or damage to the products) within five working days of receipt (date of delivery bill).
    We will then work with you to find a suitable solution (reduction, conversion (= exchange for equivalent furniture) or withdrawal from the purchase).
  2. In the case of second-hand furniture, signs of use are not contestable by the notice of defects.  For the absence of warranted characteristics (drawer cannot be opened, etc.), the notice of defects applies again.
  3. The complaint can be made verbally (on site, by telephone) or in writing (letter, fax, e-mail).
  4. Claims for defects in connection with  signs of use, ordinary wear and tear or improper handling are  expressly excluded.
  5. We offer a goodwill return for brand new furniture. You will find the conditionshere.

Delay in acceptance, non-acceptance of the goods and subsequent cancellation

  1. If the customer does not accept the ordered goods on the agreed delivery date or refuses to accept them for reasons for which Tradingzone AG is not responsible, he shall be in default of acceptance without further reminder.
  2. The same applies if an order is canceled by the customer after shipping has been released or during ongoing delivery.
  3. In these cases, Tradingzone AG is entitled to charge all resulting costs to the customer. This includes in particular, but is not limited to
    1. Transportation costs (outward and return transport)
    2. Costs for returning the goods
    3. Restocking costs
    4. Logistics, handling and processing costs
  5. An additional flat-rate processing fee per item may be charged for the additional administrative and logistical work involved.
  6. Tradingzone AG is entitled to store the goods at the expense and risk of the customer or to arrange the return transport.
  7. We expressly reserve the right to assert further claims for damages.
  8. In the case of orders on account, the customer shall be liable for all obligations arising from the order, irrespective of internal responsibilities or approval processes within its organization.

Scope of use

  1. All rights, in particular  rights of use and copyrights ;to the contributions, articles, photos, etc. made available are the exclusive property of Tradingzone AG in relation to the user.

Place of jurisdiction and applicable law

  1. These GTC shall be governed exclusively by  Swiss law ;and, unless otherwise provided by law, by the provisions of the  Swiss Code of Obligations (OR).
  2. The place of jurisdiction and place of performance for both parties is 8105 Regensdorf.

Entry into force of the GTC

  1. These GTC shall enter into force with immediate effect.
